Kindiki to be sworn in as Deputy President

The High Court has lifted orders barring Deputy President Designate Kithure Kindiki from taking oath of office.

Court has in essence lifted conservatory orders, paving the way for the swearing-in of Kindiki as the next Deputy President.

“The applications for conservatory orders are hereby disallowed. The conservatory orders issued on October 18, 2024 in Kerugoya High Court are hereby discharged and/or set aside. We grant leave for appeal,” the Judges said.

The three-judge bench led by Justice Eric Ogola is comprised of Justice Anthony Mrima and Fredah Mugambi.

The Judges said the matter will be mentioned on Thursday next week.

“We will mention this matter on November 7, 2024 at 2pm in the open court,” the judges said in the ruling read by Justice Ogola.

The High Court in Kerugoya had issued orders barring Kithure Kindiki from assuming office as Deputy President pending the hearing and determination of a case filed before it.

David Munyi Mathenge and Peter Gichobi Kamotho sought the orders after the National Assembly approved the nomination of Kindiki as the new Deputy President, a day after the Senate voted to impeach Rigathi Gachagua.

Mathenge and Kamotho have sued the Senate, the Speaker of the Senate, and two others.

The case was filed under a certificate of urgency before Justice Mwongo Richard Mururu. The case was later consolidated with others that had been filed in Nairobi.
