Big win as DP Gachagua gets back his frozen Sh202 million

Deputy President Rigathi Gachagua will be smiling all the way to the bank after judges adopted an agreement to have his Sh202 million that was declared as proceeds of crime returned to him.

After months of legal battles, Court of Appeal judges Daniel Musinga, Imaana Laibuta and Ngenye Macharia on Wednesday agreed to adopt a resolution by Gachagua and the Assets Recovery Agency to have the funds channelled back to him.

Gachagua, through senior counsel Kioko Kilukumi, and the agency told the appellate judges they had reached an agreement to settle the matter after new evidence emerged proving the funds were not proceeds of corruption.

“We are seeking the court to approve the settlement between the two parties,” Kilukumi said.

The document is dated January 19, 2023. Parties agreed to have the entire decision of Justice Maina delivered on July 28, 2022, set aside.

The declaration that the funds were proceeds of crime was also vacated.
